What is the name of your state? Michigan
Hello. This is long and complicated, so I'll try state the very basics. My son has been chronically ill for months, the current specialist thinks he has it narrowed down and has an answer for us.
All the doctors we have seen all year agreed on one thing - that when he had an "episode" he had to stay home from school. He couldn't function during a flare-up and the school was not able to properly provide the type of care he needs during a flare-up. The school was informed of this, by every doctor.
All three of my kids are honor students, my other two have no health issues and no attendence problems and are in the same school district. My son is in middle school. It was agreed that he would go to school half-time when able and that the school would call me immediately if a flare-up occurred, which made me feel safe enough to let him attend even when I suspected a flare-up may be about to happen. There were periods thru this year he was also able to attend full-time. However, when he did have a flare-up the school never once called me. They forced him to either stay at his desk or lay in the nurse's office if he couldn't sit up, and wouldn't allow him to call me.
He contintued with his school work, always catching up when he got over a flare-up. Eventually his teacher refused to give him his make-up work, he ignored orders from the principal as long as he could - the principal back up the teacher in his own personal belief but followed policy when it came down to it. The superintendant had to force the issue now and then as well. They had to "call off" the truancy officer and the police liason, both of whom have harrassed us and accused us of lying all sorts of horrible things, despite the doctor's reports. We are seeing doctors and specialists in two states, his condition is real.
Now they are taking us to court for truancy. I want to focus on my son and getting him healthy. I am tired of fighting the school to get them to support us and to help my son keep up his work, and being treated so badly. I want to sue them for slander and endagering my son - or whatever the legal basis would be, and force them to either support us or at least leave us alone so we can just do what the doctors tell us to do and get him healthy.
Any help would be appreciated.
