Complaint of Partition

What is the name of your state? Florida

I read the post below regarding the siblings, however I wanted to post this question as well.

Summary administration...only house was in probate. Mortgage still owed on property. 5 siblings. 3 siblings, including Personal Representative who is one of 3, want to sell. PR and 1 sibling only ones contributing to mortgage. Have contract on house, 3 siblings signed, 2 refuse. Bills continuing to accrue.

The 3 siblings in agreement want to file a complaint of partition. Is that really required to sell the house, because each sibiling has an interest? Or can the PR decide with majority to sell the house?

No one lives in the house, it is empty and will remain so, as long as we can afford to make the payment.

Yes, I had posted a few months ago, when I was trying to find out what a Complaint of Partition was.

It is finalized now that 2 siblings won't sign...then it was just a possibility. I've read about the complaint online, but was wondering if anyone had any experience with filing it against sibilings.

And then new questions of how long it takes, so on and so forth.
