2 questions about small claims ~

Taking someone to court for non payment to a third party. None the less, can the defendant go out hire and attorney and then file a counterclaim (within 19 hrs of hearing) file for continuance and get one. Stating that my claim is frivolous and demand that i pay their attorney fees, for this small claims? Can i be responsible for defendant's attorney fees?

I also read someone where that counterclaims needed to be no sooner then 48 hours, but they requested a continuance (based on lies) the night prior. Is this still compliant?
