My sister died without a will. She had a small life insurance policy through her work; unfortunately, she never got around to naming a beneficiary. We decided not to set up an estate for her because she owned no property and she was very far in debt to credit cards. The life insurance company will make a payout to her son if he fills out a "short-form affidavit," which asks him to list (among other things) debts and debtors. My question is: if my nephew fills out this form, gets it notarized, and sends it to the life insurance company, will this make him legally responsible for her unpaid debts?
