I am the plaintiff in a small claims suit. I won my case by default (the Defendant never showed). After repeated--unsuccessful--attempts to serve the Defendant an Order to Show Cause and several re-scheduled court dates, I filed a Writ of Execution to levy the Defendant's back account. I am not 100% sure where the Defendant banks, but I have a strong hunch.

Can I keep my current court date and continue to try and serve the Defendant the Order to Show Cause while at the same time pursuing the Writ of Execution upon his bank or must I cancel my court date until I know for sure whether or not my Writ will work?

Thanks for your time. What is the name of your state?
