We bought a used car from an individual who claimed there had been a new transmission put in the car, and that the car only had 30K on the new transmission. The car is now at a dearlership needing a new transmission. We have a copy of a service invoice (with the previous owners name on it, and signed by them) from the dealership stating the car was in need of transmission repair , but the repair was declined by the customer. Do you think we could get the seller to pay for the repairs?

My response:

Probably not. Unless in writing, there are no warranties or guaranties with a private sale. If all you have is the seller's oral statement about the tranny, then you probably have nothing with which to prove your case if you were to go to court.

Your best offense would have been to have had the car inspected by your own mechanic "before" you consumated the deal. But, since you didn't, "you bought a car" along with all of it's troubles.
