Recently in our town paper it stated that the police dept, Ohio twp , and the boro of Emsworth never had an ordiance, ACT 177, that the ohio twp police never had a legal right to arrest anyone. They took over 13 years ago and now residents now want to know what kind of legal grounds may we have if we ever where arrested by the department. The solictor of the boro stated that he told the two about this ordinance years ago and nothing was ever done. This same thing happend in sommerset county and the judge had to throw the cases out stating that it violated pa constitution? Municipalities scramble for police-protection ordinances

DAVIDSVILLE — An often-overlooked state law that requires municipalities to adopt ordinances before contracting for outside police protection is forcing authorities throughout Somerset and Cambria counties to scramble to make sure the proper regulations are in place
While most of the boroughs and townships affected by a recent court ruling quickly are going through the bureaucratic procedure, it could prove to be costly for others.
The issue came to light after Somerset County President Judge John Cascio determined that Conemaugh Township police do not have arrest powers outside their jurisdiction without the ordinances. Please help to let us know if we have any legal civil action that we can take against the boro and or the police dept. Is there any way to have our verdicts reversed?
