What is the name of your state? NH

I understand that an Employer Group Health Plan can file to have Medicare become primary and their own insurance secondary, if the employee is deemed inactive i.e. retired. Can inactive also mean they are out on disabilty and not actively working? Is this why an employer can have a person on LTD and make their Medicare primary and their EGHP secondary?

There is nothing that gets filed, the rules are just the rules. The rules state that IF Medicare is available, it will always be primary UNLESS the person is actively working. So a retired or disabled person who has Medicare and a plan through their former employer, Medicare will ALWAYS be primary for that person.
