What is the name of your state? Pennsylvania

I have been married for 24 years. Very briefly, I have a husband who does not want to work. He has a job at the US post office, but takes months off at a time, without pay. He drinks way too much and basically I am at my wits end. Since both our names are on the deed to the house, how is it determined who should move out? thanks so much!

A judge can decide. Who can buy out the other's interest? Perhaps you should sell the house, as part of the divorce, each take your respective shares, and each buy/rent your own places, moving out as part of the sale?

I basically agree with the other response that you received. If one of you can qualify to refinance the house into your own name, for not only enough to cover the existing mortgage but also for enough to buy out the other's share, then that person would likely be able to keep the home.

Otherwise, its better to simply sell it, split the proceeds and move on.

You don't mention if there are children involved. If there are, the answer may vary. If not, it becomes a simple property division issue and (in theory), it doesn't matter all that much since the equity accrued during the marriage will be split, anyway.
