In state of PA. Party A is executor of will. Party A is also trustee of a trust. Will and trust are from two different people but they are related. Party A, Executor of will disbursed money from the estate of deceased to the person that he is trustee of. Deceased did not owe the person who owns the trust any money. Reason Party A gave for disbursing money from the estate of deceased is because Party A did not know how to get money from the trust. Is it legal for the executor of a will to disburse money to people that are not beneficiaries? The person money was disbursed to was not in debt to the deceased, so he wasn't paying off deceased bills.
Will of deceased named beneficiaries with specific amts to be given to said beneficiaries in a codicle. Party A disbursed money as stated in codicle to the named beneficiaries. More than a year later, Executor disbursed more money to those beneficiaries named in the codicle. THis additional money is not mentioned in the will or the codicle. Executor states deceased wrote this on a piece of paper and that is why he disbursed additional money. Is this legal?
Also deceased owned a joint checking account in another state. The money in that checking account belonged to the deceased. Upon the deceased death, the joint owner closed the account and kept the money. I'm not sure how the checking account was set up, so I have no idea if this is legal or not. SHould this money have been turned over to the estate of the deceased? The executor knows that this money existed.
What recourses do other beneficiaries have if all of this is illegal?
