I just had a retraining order for harrassment dismissed by a court commissioner. My question is can I now sue the person in small claims court for lost wages,attorney's fees ,slander and defamation of character? The issue is on the court website and any future employment could be denied because of the false filings on the other party.

Small claims court is for actual monetary damages and limits the amount the can be claimed for attorney's fees. Things like slander and defamation of character are arbitary damages and are not heard in small claims court.

Thanks for the response RACER 72. I need to know if the atorney fees for representing me for the case are recoverable? I know you stated maybe,how can i find out? Is there a limit for the attorney fees?

Also,if I file can i recover also the costs involved in filing the small claims case?
