My mother-in-law is getting a divorce in Indiana. She and her husband are separated and living in different cities. She will be having a medical procedure and wants some legal document in place so that if anything happens to her during the procedure her adult son can make decisions for her and fight for her portion of the property and assets in the upcoming divorce. Division of property has not taken place yet, and she wants to ensure that if anything happens to her, her belongings can go to her family and not her husband. Her husband is not the father of her children. Would a Power Of Attorney be the proper paperwork for this situation?

A: She needs a will or a trust or both; a power of attorney dies when she dies.

BUT she needs a healthcare power of attorney and a financial power of attorney for her son to handle her health concerns and financial problems (if she cannot) while she is alive.

Tell ma to go to a lawyer before she goes to the hospital.
