My friend is trying to file for divorce from his wife. They are no longer living together and haven't since November. He is at the moment unemployed and only receiving unemployement and cannot afford to pay the $320 filling fee. He wants to file In Forma Pauperis, but they ask for his spouses income, which is around $30,000 per year. Since they are not living together and he has no access to her income, does he have to put this down? He then would not qualify for the fee waiver, but she refuses to pay the filing fee.

Thanks in advance for any help.
