What is the name of your state? VA

I currently separated and my 6 month separation period has now been met. My lawyer drew up divorce papers and sent them to my husband and now he will not sign them because he is overseas in the military. My lawyer says he is waiting until he returns to serve him with divorce paper. What is the difference in me giving him them and him being served?

They have to be legally served by a third party.
