What is the name of your state? New Mexico and Texas
We are the grandparents of a 12 year girl who has lived with us since the day she was born, we live and have always lived in Texas. The legal father is not the biological father and lives in New Mexico. The child wants us to adopt her, but the legal father will not sign the termination paperwork. Texas has very stringent involuntary termination laws, New Mexico has a provision that if she wants us to adopt her and the relationship with her "father" has disintegrated they will consider the termination of parental rights. We would like to file the termination in New Mexico and finish the adoption in Texas. The birth mother will sign the termiination paperwork. For just the termination of parental rights in New Mexico will having the father live there satisfy the courts need for jurisdiction or does the child have to live there also.
