Are YOU on the lease? He has a right to remain until a judge tells him otherwise.
If you are not on the lease, the LL has agreed to lease to him, and you have no legal right to remain as a tenant in husband's absence without the LL putting you on the lease instead. Remember, this is not just an issue between you and husband, it is an issue of responsibilities and agreements with whomever your are leasing. If I rent to A, that does not mean I have authorized B to be my tenant. Additionally, if both are on lease, the LL can hold both responsible to comply with lease terms.
