i was arrested and charged with possession of child pornography in january in salt lake city, utah. i came across the material on the internet, then recorded the images on a camcorder to save it. the camera was new and i thought it would be interesting to save it. i'm not a pedaphile; it was something more of curiosity. i have no previous charges or convictions regarding any kind of child pornography. i have retained an attorney who says there is not a lot of case law in this matter. the feds were investigating another case in which i was involved; i'm a former private investigator. they stumbled across the images on a video high 8 mm tape. i willingly gave them the tape and other information as i wanted to cooperate and had nothing to hide (i thought). i'd forgotten the images were on the tape. the tape is more than 5 years old which exceeds the statute of limitations in this matter. i'm familiar with the mandatory sentencing guidelines and i could end up in prison for 5 years which is something i don't deserve. any suggestions or case law anyone knows about? thanks.

Gosh hone thats a drag try mapp vs ohio its not like im a lawyer but I sure do not want the right to freely read what ever the hell I want to be denied me. now sure you dont want to read it either but what do we want someone to have the right to make sure we are not?UNACCEPTABLE!So its a vital thing to defend your right to not be judged so unreasonabley We read every day about death,murder crime HAS THIS cpompelled us to commit these ACTS?No it never will either,and what gives them the right to abridge thje freedom to read?No power ever imagined to be vested in any cornor of this federal/state goverment was remotly close to such an outrageous extension of authority THe founding fathers werte not that ignorant ASk them CAN you say POLICE STATE?What nazi image must we construe into GOOD christuian citizen today?Good luck MAY THE COURTS BE WITH YOU

My question to you - you say you have retained an attorney - yet you are seeking legal advice on a free legal forum. That frightens and perplexex me! You have you freedom at stake - if you do not feel your attorney is competent - find a new attorney! But simply because the attorney says there is little or no case law out there on this issue does nto mean the attorney is not competent - it smiply means there may not be a case on point. So - you either have to trust your attorney - or get a new one.
