The nominated executor of my grandmothers will told me they could not act due to stress.
I relocated from WA. to CA. to handle the affairs. She signed a declination, and a nomination for myself to be the executor. I sent bond waviers to family members, while waiting for replies, my aunt found out that she could collect a % of the estate(which cured her stress). She withdrew her declination. The probate hearing is soon, due I have a leg to stand on when I go to court to ask that she not be appointed executor? I am the only living decendent and the major beneficiary.

If you really want to be the executor, then simply present your case, including the declination statement. While the nomination would typically be confirmed, you have the opportunity to contest this, especially given the actions of the nominee already taken. It could go to show lack of dependability of the nominee.
