When someone has a living trust do they need a will? If a living trust means you can avoid probate, does that also mean no one can contest the trust?? Thank you for any advice you can give us.

DEAR PEGGYMARIE:

A will is not absolutely necessary when you have a living trust, but it is usually made in conjunction with the living trust.

A trustee can't be removed unless fraud, negligence or neglect of duties is involved. The trust can not be contested, since it was made while the decedent was still alive to achieve his/her intended purposes. However, if you have valid proof or evidence that something inappropriate may have occurred, you need to write a letter to the probate court so they can know what is going on.
