I moved to Kansas in Dec.99. I have had 2 previous back surgeries. One work related,in 1996. the other wasn't which was in 1986. I was doing cna work (Nursing) when I injured myself in 1996, I was retrained in the nursing field as a med aide. When I moved to Kansas, I returned to doing my former job as a cna. and I reinjured my back on Jan 3 2001. My employer called me the day after the injury, to inquire about my injury and if I wanted to see the company Doctor. at that point in time my back was feeling better. It was sore after working my shift. But I felt it was healing.So I didn't go see the company doctor. Approximately 10 days later I came down with bronchitis and was out of work with a Doctors note. The 2nd week of my bronchitis my cough got deeper. which put a strain on my back. I am now over the bronchitis but out of work due to my back.. I went to the doctor that I had been seeing for my bronchitis for a follow up visit on my bronchitis and told him about my back pain. he prescribe medication for me and told me if it wasn't better in a few days that I would need to go for an MRI. Which I did end up going for. It showed that I have a nerve being pinched by a piece disk fragment and scar tissue. the doctor told me that I would need surgery and set me up to see a specialist. When I went to see the specialist, I wasn't allowed to see the specialist because the injury could be work related. They told me I would need to get approval from my employers first. Which I attempted to do. My employer told me that they would need to file the claim with the workers comp. and that workers comp would be in touch with me. Workers comp called me the next day friday the 9th of Feb. and asked me alot of questions and taped the whole conversation.I had taken my medications about 2 hours prior to his phone call, I was unable o give him dates and times due to the confusion the medications were causing. He told me that my answers were different then those of my employer. I believe he was refering to the dates and times. I was told I couldn't see my regular doctor that I had to call Workers comp. on Monday to set up my appointments with a doctor... The man from workers comp. told me that my employer requested an investigation. They have asked me for permission for all of my medical records dated back to my original back injury.
Should I be hiring a lawyer. I am not from this state and I am very unfamiliar with the workers comp laws. I am in alot of pain, I can only sit up for about 20 minutes at a time. I have been informed by Workers comp. that they may not cover my injury because of the 10 day span in between my work injury and my pain from the coughing spells.
