After pleading not guilty to a traffic ticket (Unnecessary use of Horn), I appeared in court (Suffolk County,NY) on the scheduled date. The complaining officer did not show up for the hearing. The judge rescheduled the hearing, even though I requested a mistrial.
The Judge said the officer wasn't present because of an emergency, and was allowed a second chance.

Two questions:

(1) I'm sure I wouldn't be allowed this courtesy, is this legal?

(2) The same scenario occured with the previous 6 defendants in court that day....I have real doubts about the veracity of all these officer's "Emergency" claims....How do go about subpeonaing my officer's daily activity report for that day?

Okay, go to your local superior court and do two things: get a subpoena duces tecum for the activity sheet and get one to subpoena the transcripts of the court hearing of that day.
