How do you find out if a will will had been probated or not??? We are the heirs of our father who has passed and he left everything to his wife,our stepmother, supposedly. We are not sure if probated the will or not. He has been gone for nearly 3 years now. Can someone please help eith the questions that I have??????

You made a mistake by not asking a question on your original posting.

Check at the county courthouse probate court to see if any probate has been filed. If not, then if you think he had a will and that stepmother is deliberately withholding it from court, then open up probate yourself and consult with an attorney to find out if the judge can ask her to produce the will if she has it or if you can cancel probate if there is no will or no assets.

Contact the probate court in the county in which your father resided. You can do an internet search for the county website to get the phone number. There are some counties (for example, Dallas) that have case records online.
