a general contractor owed us money, we placed a mech. lien on property/house. we were told the lien was void because it was not done properly and that the contractor is now able to collect damages for filing a squrious lien. we can prove the contractor still owes money and therefore the lien was not groundless, nor did we knowingly file it improperly. as soon as we found out the lien may not be valid we released it. the contractor is still countersuing 2 months after the lien was released. is it up to the judges discretion or is it in cement?
