Hi,

I have a family friend who had a contract with a company regarding rental of a handheld radios. He had a company which dissolved into another company which took up payments, then ended up no longer making payments. The company served all parties (family friend) and the company. Neither showed up to court, which resulted in a default judgment. The judgment was over 10 yrs ago, and just recently garnished against his bank account. My question is can he sue the company owner who assumed use of the radios after he dissolved the company (and ended up quitting the radio using company) even though it is over 10 yrs ago to recover the garnishment?

Nope, the statute of limitations expired long ago.

Thanks for the reply. That's kinda what I figured - I told him his best bet is to fight the garnishment stating that the other individuals named need to be included until he can figure something out w the attrny who is collecting. Any other suggestions, or is he SOL?
