my 15 year old daughter was in a vehicle occupied
by 2 adult males & another 15 yr. old female, the car
war originally stopped by police by misidentity they
new it was the wrong car-wanted to ? driver on theft
charges after they got the car to the police station
they said they smelled marjuana on the males then
proceeded to the car where the females where, they
searched one females purse & found 6 marjuana
cigarettes & then asked is anything else was in the
vehicle, they found less than 3 grams in the trunk, the
2 males were charged but later charges were dropped
to a misdemenor & a fine payed, the female found
with 6 marjuana cigarettes had to sign a paper saying
she wouldn't do it again, the females were never
read their rights, my daughter had juvenile charges
filed on her & has to appear in magistrate court, what
should i do? there was no testing done on the
substance.

Well, they weren't arrested so they were not read their rights because nothing like an interrogation/questioning was done on them.

As for what to do......try to get a hair sample done on your daughter's hair (psychemedics) so that it tests for use up to three months before.

drug charges on 15 yr. old daughter

thank you for your advice, the police did not allow
my daughter to call a parent or attorney, & did not
do any lab testing. They came to magistrate court
with no evidence & no lab report. The police were
wrong not to let my daughter call me, in our state
a child between the ages of 12 to 16 cannot be
questioned without a parent or attorney present.
The case was dropped.
