What is the name of your state (only U.S. law)? North Carolina

I am from Texas and my son was born in Texas 3 years ago. My son's biological father is on the birth certificate but I have not seen or heard from him in 2 years. I have no contact information for him whatsoever and have no idea where he is. My husband wants to adopt him because he's the only father my son has ever known. What do I do to waive his rights? Or where do I even begin? Do I have to take care of it in Texas or can he adopt him here in NC?
