I live in Illinois. My husband and I have 3 minor children and I wanted to know what would happen to the children if he and I were to die and no guardian is named. We don't really have any close family/friends to leave them with.

Even if you do not nominate a guardian in your will(s), someone (or many persons) can petition the court to be named as the child's legal guardian. If no one steps forward, then the children would likely be placed by the Dept of Childrens Services.

I strongly suggest that you think about who you would like to raise your children and designate guardians in your will(s).
