What is the name of your state (only U.S. law)? Michigan

My son recently got his second MIP here in Michigan. He was already on probation for six months and due to this second MIP the probation was terminated as unsatisfactory. What will happen when he goes to court for his second violation?

The court gave him a break and offered probation, hoping that he would learn from his 'mistake' and conduct. Clearly, he abused that PRIVILEGE... and the court will likely revoke his probation and reinstate his original sentence.... plus a new one.

What will happen? Depends on his age. Is he over 17??? If so, send him to court with a toothbrush... and soap on a rope (tell him to NOT bend over to pick up any soap he might drop in the shower).

Your son, by violating the terms of his probation, will have his first MIP recorded as a conviction, and he will have to report this conviction on any school or job application. Had he satisfied the terms of his first probation, his MIP would have been discharged and dismissed and there would have been no public record of it (although the Secretary of State would have kept a non-public record for use by law enforcement).

Your son is no longer eligible for any diversion program.

With a conviction on a second MIP, your son is facing up to 60 days in jail and a $500 fine, suspension of his driver's license, community service hours, substance abuse counseling and treatment (at his expense), and random or regular drug and alcohol testing.

If convicted of this second MIP, he will have two alcohol arrests and convictions that he must report to schools and employers on any application. This will probably limit his educational and employment opportunities.
