i worked for a company for 1 year and i had to sign a contract. i worked for a swim school and the most disturbing part of the contract states.. you will not (either during, or for one year after termination of your contract with the company) within the counties of dade, broward, and palm beach, individually or otherwise, solicit business from clients of the company or otherwise, directly or in directly, be involved in the ownership or direction of another swim school.
my question is this. if customers of said swim school are requesting my services(by calling my home phone) due to thier dissatisfaction with the service at said school, would i be violating any part of the contract that i signed while being employed with said swim school.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Semantics aside: the language itself makes the contract unconscionable and thus voidable. Why? Because it restricts you too much. It is not done in good faith.


But if you want to go from the position this is a binding and enforceable non compete agreement, you didn't solicit if these people call you. As such, do not worry.
