CPA Successor Trust Failed to Perform Duties

What is the name of your state (only U.S. law)? Florida
April 2007 mother-in-law declared legally incompetent. Per Trust CPA “Mary” became Successor Trustee.

CPA did not pay bills or paid very late, Medicare D cancelled due to her not paying bill.

Family & atty calls, letters not returned for months. After reaching her:

CPA agreed to turn trust over to siblings ONLY if they signed a document that:
1) Released her of any wrong doing
2) No annual accounting required from her

OR she would turn the trust over to a bank that charged a high fee. Family signed.

I feel it was blackmail.

QUESTIONS
Can we still report her to the state for not performing her duties?
Are we bound by that document we signed?

FYI-I had rad the state statutes prior to original post.

Family’s calls, letters not returned. Family friend, a criminal atty called, sent letters - not returned.

Family finally reached CPA on phone about 50 days ago. We asked her to turn trust over to siblings. Only way she would agree to that was if the siblings signed a document releasing her of wrong doing & that it was okay that no annual accounting was ever done. If we did not sign that she would turn the trust over to a bank that charged a high fee. Family signed.

I feel it was blackmail. Can we still report her to the state for not performing her duties? Was that elder abuse by not paying for her Medicare D? Are we bound by that document we signed?
