What is the name of your state (only U.S. law)? Georgia
Charge: Public Intoxication; Class B Misdemeanor

Hi,
I recently attended a football game at the University of Georgia, where I am a student. The vast majority of students in attendance have been tailgating all day and I'd venture to guess more than half bring alcohol in. After stopping for a coke and mixing myself a drink from the pint in my pocket, I went to go find my seat. There are GBI officers stationed at all student section entrances, and a couple stopped me as I was entering my section. He told me my drink looked watered down and asked if he could search me. As alway, I declined the proposition. They immediately grabbed one arm each and proceeded to escort me out. While on the elevator on the way down, one patted my back pockets and pulled out my pint. Against my better judgement, I decided to ask them their badge numbers, if for nothing else than to let them know I'm aware of my rights, and possibly prevent them from being as over-assertive with another student. The hadn't cuffed me so i was able to reach into my pocket and type the first one's onto my phone. The other immediately cut in as the first finished, not allowing me any time to take down the information. By this time they had shoved me out of the gates and told me to get the hell out. I asked the second one for his badge number again. He said he had already given it to me. My blood was hot, but I was still reasonable calm when I told him it was too damn fast. He immediately cuffed me. I had no idea why. Since then, I have researched and discovered that profanity is cause for public intoxication arrest. They charged me but read no Miranda -- apparently unnecessary for class B misdemeanor. I carried on a polite conversation with the two local officers who were watching me until transport arrived. After seven hours in jail -- with some unnecessary lip from me and some unnecessary force resulting in my head being slammed against a wall by the sargent-- I had a bondsman bail me out.

I am wondering:
A) What is the likely consequence of conviction. I know max fine is 2K and 6 months, but I am wondering what the likely sentence will be, given the story I just laid out.
B) What are my chances of defending myself in court? I really can't afford a lawyer in my situation
C) Alcohol is prohibited in the stadium, but I'm pretty sure it isn't illegal. In any case, they threw away my pint on the way out, and I wasn't arrested until I was outside of the stadium (still on campus, however). I was never breathalyzed. Assuming the two GBI officers even show up in court to give their side, is there sufficient evidence for conviction?
D) What should I do?

Thanks in advance,

Are you 21 or over? Was there a breathalyzer? What evidence is against you for being intoxicated? You may have to go with the "I'm always an ass anyway" defense. Is there a video of you at the jail and if so how are you acting?

If the answers to those are good enough, you got a shot.

I am 21. There was no breathalyzer. I'm assuming the only evidence of my intoxication was using the word "damn." In the jail I slept at all times in my cell. When I was called out to see the sergeant to sign the citation he asked if i knew what I was charged with, I told him i didn't know there was a charge for asking a cop his badge number. The sergeant snatched me up, walked me back toward my cell, introduced my face to the cement wall, and threw me back in the cell for a few more hours. They eventually got someone to do the nice cop routine. I signed and got my phone call. I'm not usually not an ass, but sometimes Area's Finest can get my blood running. I'm not sure about video, but I'm pretty confident if there is it wouldn't me handed over to me, or would have been accidentally deleted. They've got there own rules down here. Thanks.

Followup

What ever happened with the outcome of this case? A similar situation happened to me just yesterday. Giving the ACCPD some heavy lip downtown and got taken in for public intox and littering. I am over the age of 21. I had good friends tho so i only spent 1.5 hours in jail before they came and got me. I have a summons for the 17th but I'm not really sure what to do. I feel like i should just pay the fine and get this whole situation over with. Any comments would be much appreciated. Thanks!

Advice

Also, any advice would be super helpful. I talked to a (good) lawyer and he told me that this was booked under local municipal court. He also stated that I should try to get it dismissed by doing pretrial diversion. Honestly, I just want to get this off my mind. I feel like paying the fine and just getting on with my life would be best. He also stated that because it was local it may not go on my record. Could someone help me out here? This is my first run in with the law EVER. and it suckss

PS. I am applying to medical schools this year. Luckily all my applications are out, but there is a chance i may have to reapply in the future. Just a thought

ANY HELP would be awesome. Thanks in advance. If you need more info let me know.
