can a person be arrested for theft if they use their company credit card for personal purchases but reimbursed the company? how could/would intent to defraud be proven?

Did you reimburse them before or after you got caught? How did you even plan on making credit card payments before anyone noticed the charges showing up on an accounting ledger, or did you work in accounting? It wouldn't be any different than "borrowing" money from the petty cash box without permission.

What is your company's policy on the matter? At a minimum, it may be possible for them to take you to court over a breach of contract.

I'm with occultist on this.

as to proving intent;

as to theft; maybe not but conversion would be a very likely charge and does not need to prove intent, just use against policy.

With what little info given; Yes, depending on the circumstances.

Why are you asking?

Does the company have a history for accepting reimbursements from employees from using company cards?
Does the company ever reimburse employees for use of the employees funds for company expenses?
Did the company ever have a written or known policy regarding this issue?
Have you or anyone else ever reinbursed the company for use of company CC's?

They probably won't press any type of criminal charges but you will most likely be pounding the pavement for a new job.

If you can't be trusted to behave properly with company property, then you can't be trusted at all. Get ready to pack up your cubicle.
