What is the name of your state (only U.S. law)? missouri. I have an aunt who has had a long standing gambling problem. She is 84 years old, she has lost her home and has to be out of it by January2, 2009. She is sitting in her home without lights, and heat and refuses to leave. She recently sent all her money to someone in Nigeria (an interent scam) she has been involved in for 2 years, which got her in the position she is in now.
We have contacted social services and they have not come out to the house. What do we do? How do we declare her incompetent so we can get dual power of attorney? Please someone help.

Power of attorney will not help you at all.

Talk to a family law attorney about how you can acquire conservatorship.

And you need to be making a report to the police and/or the district attorney or state attorney general about the internet scams so they can be investigated and if enough information is found an attempt can be made to recover some or all of the money.
