How do we get a durable power of attorney after a person has had a dibilitating stroke?
My 77 yr old FIL gave us(my husband and myself) the POW for Health before he had surgery, along w/ his Living Will and Do Not Resucitate. He had a Global Aphasia stroke which has serverely affected his ability to speak, understand speech and to write (along w/ being self-sufficent). He will need to be placed in a nursing home and will need to use Medicaid. He is currently in a rehab facility under Medicare.
We will need to cash in his only assets - his life insurance policies totaling about $20K - to place him in the home. The insurance companies are requesting a Durable POW.
How do we get a Durable POW if he barely understands us when we speak to him, and he cannot write? He could possibly use his non-writing hand to scribble.
