HELP ME!! Towed my vehicle in my parking lot for expired license

What is the name of your state (only U.S. law)? INDIANA

ONE month back i moved to INDIANA from PHILADELPIA. And did not change my license plate.

I have parked my car in my apartment homes parking lots and went out of country for 3 weeks. and in mean time, the license plate got expired.

I came back and noticed my car was disappeared, and contacted the apartment office , they gave me the TOW-COMPANY phone#, and told me they towed unauthorized vehicles. Apartment Office says they can't do anything on this.

The Tow company is telling me to pay $600 with in 30 days, otherwise they would give this car for auctions.

1) Can the Tow Company tow the vehicle for expired license plates of PARKED cars (in my apartments) ?

2) My apartment does not give me any kind of sticker or tokens for my car, NOR noted my car number in their system. Then how it can be unauthorized ?

3) Do you think i should go to COURT ? I don't have enough time now i am afraid they will give my car for auctions if i don't turn up.

4) How should I approach the court , where to initiate ?


Please help me what to do?

Yes, redeem your car first. The charges are continuing to mount. Your car will be sold at auction if you don't get it back. You can try getting the fees back from suing the towing company or the apartment company if it is warranted.

What does your lease say? Leaving cars immobile with expired (and out of state) tags look like abandonment.

Does your lease state that the apartment complex tows unauthorized vehicles, or is it posted anywhere?

Did you let them know you would be away for three weeks? Surely you knew the license would expire during that time.

I've never heard of a car being towed for an expired license. Abandoned and expired, more likely.
Happens all the time. If it doesn't move and it doesn't have valid tags, it's abanoned in as little as 3 days as far as things are concerned around here.

When I lived in an apartment, the lease specifically mentioned that the parking lot was not for "storage" of vehicles. What that meant is that if it is not legally driveable (including expired registration), it should not be there.

A temporary management person from another town had my pickup truck towed because she was under the mistaken impression that it had not moved for 3 years, due to a 3 year old EPA sticker and 3 year old city sticker. But IL EPA had discontinued window stickers several years earlier and my city discontinued vehicle stickers because they were getting plenty of money from the river boat casino. My registration was current, but my tires did leave ruts in the asphalt from parking it there for 13 years.

That prompted me to finally start looking for a home.

Yeah, I had my tax stickers scraped off my car when our county abandoned them (also got rid of my NJ inspection sticker after I moved out of state). Just need some inattentive yahoo cop or parking guard to not realize that the reason they were expired was because the need for them had been obsoleted.
