What is the name of your state (only U.S. law)? ca
I have been on disability for over 2 years and my CA employer has not terminated me. It seems as though they are saying it is my decision to retire or resign otherwise they won't/can't terminate me. Is this so? If I take my company pension, the amt will be deducted from my LTD so I figure I may as well remain on the books and let the pension accumulate.

They CAN terminate you, but they are not required to. Your pension accumulates even when you are not earning any wages? Consider yourself lucky, few employers would allow this anymore.
