If an employee has been working as a private contractor (1099 status) and their employment is terminated, does the employer have a right to hold the employees personal property in lieu of money the employer says the employee owes them?
For example: A tattoo artist working at a tattoo shop is terminated by the shop owner. The shop owner says that the artist owes them money for supplies used. The shop owner tells the artist that they will be holding the artist's equipment and tools until the debt is paid, even though the artists equipment and tools far outvalue the amount of money owed to the shop owner.What is the name of your state (only U.S. law)?
