What is the name of your state (only U.S. law)? Nevada~~I worked at a casino with a union in Nevada as a bartender. The casino I worked at allowed employees to play on off duty hours and to obtain and play with a reward card. While off duty I evidently played a machine that put to many points on my card. I don't know how the points add up on the card, just that the longer and more you play the more points you get. I was fired because one of the machines malfunctioned and was putting to many points on my players card and who's ever card that played the malfunctioning machine. Management said that I should have noticed the malfunction and reported it. I am not a slot tech nor am I trained in that field. I was off duty spending my money. and there for my recreational time, not to look for machine malfunctions(not that I would have known what to look for.) I was employed there for 10 1/2 years. Do I have a case for wrongful termination in the state of Nevada.

No, you don't.

Wrongful termination does not mean what most people think it means. Unless a specific law exists which prohibits the employer from terming you for the reason they did, it is not a wrongful term.

There is no law which says you cannot be fired for not noticing a malfunction, even if you are not trained in it.

what about when there is a union involved, and a grievance filed. Are you familiar with players cards or casinos and how they work? 1000's of people played the same machine, including other co-workers. I was not aware of the malfunction until management told me. When I asked about all of the others who played the same machine, I was told that they were not concerned about them right now, just me.

It keeps getting tabled during resolution meetings. I played the malfunctioned machine the end of July of 2008. I was suspended on 11-01-08, and let go on 11-07-08.

That the company has stooped to a new low, and that they will take it to arbitration if need be. The company says that I was fired for not reporting the machine, There is no documentation that tells you how the points are earned when you sign up for the card. Nor does the company train the employees on how they are earned(what amount of coin in equals what amount of points.) How can they say I new there was a problem with the machine, when I have repeatedly told them that I did not.

It may be a violation of the union contract. I don't know because I haven't read the union contract.

But even if it is, that does not make it illegal under the law.

Your recourse is going to be with the union, not with the law.
