Ok, here's the situation....

A friend of mine (age 34) served 6 months in prison for a felony unrelated to the current situation (Class D, battery). He has been out for about 4 years now. Well, a few days ago he was caught shoplifting $107 in merchandise from a store. When the alarms went off, he ran for it. He stopped and surrendered when he had ran into a fence. He was them taken back into the store and awaited the cops. They let him come home, but told him he will be recieving a court order in the mail in a couple of weeks. He is extremely worried that he will go back to prison. He has not been in any other trouble since he left prison that first time, until just the other day with this shoplifting incident.

What is going to happen? What can he expect?

We are both really worried

You should be worried. Is he on parole, probation, or any suspended sentence from the previous charge? If so has he talked to his PO?
