What is the name of your state (only U.S. law)? PA

I have had back problems for quite some time. I am on FMLA and it is just about out. I will need surgery which has a 6 month recovery time. I have been told that since my FMLA will be out that they can fire me. This is not a work injury. Can they fire legally fire me?

Yes, they can.

Unless your back injury is the direct result of serving in the armed services, there is no obligation to hold your job after 12 weeks.

If your back injury is service related, that extends to 26 weeks.

Your employer has no legal obligation to hold your job beyond the limits of FMLA, regardless of the need for additional medical leave.
