I live in illinois . My question is how do i get copies of statements that were made about me which lend to my termination. I was told a couple of employees made such statements. The clerk of the court said since there was no case file they cant help me. How do i get this from my ex employer.:(

If those statements were written and are part of your personnel file, you may be able to see them. IL reg's state that an employee may make a written request to view their personnel file. The employer may lawfully withhold certain types of documents however: medical records, letters of reference, information about a person other than the employee, records subject to a court proceeding, or any records alleging criminal activity.

And even with a validly executed subpoena, you still might not. What you can do instead is have someone get a notarized, written statement from each employee as to what they said.

Since you have no basis to have a court issue a subpoena (i.e. you haven't filed suit against the employer), you can't.
