What is the name of your state (only U.S. law)? New York

My fiancee was fired from her job a few weeks ago. She was never told in any way her job was in jeopardy and never received any written warning for work activity (and other people in her department did.) She also worked ther for 7 months, so she was off of what the employer called a "6 month" probationary period.

One day she went to work, she worked the morning, they told her to go to lunch earlier than usual. When she came back from lunch, they told her to come to the office. HR manager, her manager and one other member of management team were there. She was told she was being fired. No reason was given. She asked why, no reason was given. She asked if she would be able to use that employer for a reference, the said they will not give her a reference for any other jobs she applies to. She was then escorted out of the building.

She was never written up, always stayed late when the job required, never missed a day of work, and never came in late. She received 2 reviews during her employment, her last review was given to her only a month before she was let go, and it said she was doing a good job and improving in all areas she needed to.

Finally, she has since applied for a couple of other jobs in a similar field. She had excelent interviews for both. The last one she went on, she had a 2.5 hour interview, the manager at that location even asked her to stay longer and 'try out' some of their equipment. He then said all he had to do is check her references, and he would call her in the following week to meet the owners. He even brought up some 'general' ideas of what he would be able to offer her the following week in terms of salary. After leaving, she never got a call, and a week later got a notice saying they decided to go with someone else. The other job she applied to also gave her the same notice.

Finally, I'm not sure if it matters, but she is of hispanic descent (it wasn't a known issue with her past employer, but I do know she was the only non african-american minority there) and she also was one of the few people at her job not from the area (she was born and went to school in NY city, we do not live in NY city now).

I'm wondering if there is anything she can do to help in getting a new job, or if she has any kind of formal complaint/case against her former employee. All of her work history is stellar, she has multiple degrees in her field, an excelent work history (before this position had a stable job of over 7 years at one location with an excelent attendanc record), and even her grades in colleage were stellar. Thanks.

One othe note to add to the situation above. What we are concerned about is in our city, I don't want to use the term 'black listed', but we are afraid that in her industry, the competive firms all know each other and a 'bad' referal, without us knowing the reason, will not allow her to get a jobs.

She has received calls, and even offers asking her if she will relocate, from other areas across the state and in neighboring states. Yet, in our area in just the past couple weeks, whenever she applies for a job she is qualified for, she either immediatly gets a rejection letter, or has the promising interview like stated above, only to get the rejection letter later (after the employer contacted her previos employer in the area.)

As long as whatever her ex-employer is telling her prospective employers is the truth, they can tell them anything they want.

Why don't you call them and ask for a reference for her, and see what they say?
