What is the name of your state (only U.S. law)? OHIO

Can a POA alternative act at any time at the request of the appointer?

In the POA document, it states:

"if at any time my son, XXXX XXXX, is not readily available or is unwilling or unable to serve or to continue to serve as attorney-in-fact or guardian:

FIRST ALTERNATE: My daughter, XXXX XXXX of 123 Second street.

Said alternative attorney-in-fact or guardian shall have and exercise all the authority conferred in this instrument and shall serve without bond, and said powers shall not be affected by my disability.

No, the alternate CAN DO NOTHING AT ALL until the original POA is dead or sends the alternate a written declaration declining the POA for whatever reason. The alternate has no power at all while the official POA has been granted the POA.
