What is the name of your state (only U.S. law)? Kansas


My father in law recently passed and was curious how pensions and SS works? He only retired 3 yrs before he passed. He paid a LOT more in than he got out. Do these retirement benefits just go away now that he has passed? He had a trust setup but no mention of these assets in it. He was generally pretty good about planning. Not sure if all this is just lost or what.

You/his next-related will have to contact his retirement fund.

Some pensions allow an election at retirement, as to whether the retirement is reduced to allow the beneficiary to receive a payout, and some have no residual value.

Many retirement funds pay a one-time death benefit to a designated beneficiaty.

Options vary depending on the specific plan and the choices the retiree made.

Whoever is next-relative should have contacted the retirement fund, even just to advise them to stop remitting the checks (they have to be paid back if they are direct deposit & no one advised the fund of the death).

Regarding SS, contact them regarding the death. All SS checks received in the month of death and afterward, have to be returned to SS.

Surviving spouses, younger than retirement age, can make a new claim for benefits, and children of the deceased also qualify for a monthly stipend.

Funeral directors contact SS and report deaths. Depending on when SS benefits are received and when a person dies is whether or not the monies from SS have to be returned.
