a male who just turned 18 was arrested for 6 felony counts. 2 were for stolen autos, the rest stem from a burglary. the burglary was a friend of his mothers home. the friend told him what to steal, where items were and left door open for him to enter. money and guns were stolen from the home. can charges be downgraded on burglary related charges due to help and suggestion of his friend in stealing items. lawyer was not present when he was questioned and his mother must depend on public defender. any help or advice greatly appreciated. thank you!

Why would they downgrade the burglary charges? They are lucky they did not get charged with unlawful entry or breaking and entering. A lawyer does not have to be present during questioning, he can just refuse to answer the questions. The Miranda rights only guarantee an attorney before you appear in court. The friend should also be charged with aiding and abetting. Only 18 years old and looking at 10 to 20 years, guess you could say by the time he gets out he will still be young enough to become a productive member of society, but I wouldn't count on it.

If you are under the age of 19, aren't you entitled to juvenile offender status???
