I have a tree company in the bay area. I have foreman that has worked for me for about 6 months and has not performed very well. He has about 6 verbals and 3 written write ups on various issues. He recently injured himself not following company protocol and he needed a week off for a minor bruise on his leg. Can I fire him when he gets back or maybe demote him and lower his hourly pay, without it looking like it was due to his injury (which it is not)?
