False Arrest?

I was catching a ride home with a friend there were 3 other people in the car,
cops pulled us over because the license plate wasn't in plain view.
The driver gave him permission to search the car they found soboxin
in the back seat cuffed us 2 in the backseat said we were in reaching distance,
and getting a class w drug charge, let the driver and the passenger go.

When we got to the police station all they did was repeatedly ask me
who i bought it from and after that didn't work they tried to get me to
say it was the other guys which it was, but i didn't say anything.

After about and hour they started acting like I was their best friend saying
they knew it wasn't mine and that this "wasn't a false arrest" and that
they "did me a favor by getting me closer to my home".

Any wrong doing? A little mad right now, we were on the side of the road
for 20min+ searched me 4 times, was almost hit by a car twice, and at the
police station after they knew i wasn't going to let up started asking me
about "known dealers" and if I had any information.

Legally speaking, you were absolutely in possession of the substance they found. If you wish to fight that, you will certainly require the aid of an attorney.

As far as you feeling you were inconvenienced (time wasted due to multiple searches that you feel were unneeded, nearly being hit by oncoming traffic, etc.), you may file a personnel complaint with the police station against the officer(s). Due note, however, that this will have absolutely nothing to do with your legal issues.

Back to getting an attorney, whether or not you wish to fight your ticket, I advise retaining an attorney. A local attorney knows best what the courts want to hear, and as such present the highest potential for yielding the most favorable results. Many attorneys will offer free/cheap consultations, so take advantage of this and sit down with a couple to see what insight they may have to offer.

Thanks for the reply,

They didint charge me with anything they let me go,
had to walk all the way home.

I was just wondering why they were acting all buddy buddy
with me right before they let me go, making it a point to tell me that this
wasn't a false arrest and that they did me a service by getting me closer to
my house. still had to walk 4 miles in 10 degree weather.


I found out that they did charge the other person, he called me and said it
was based on the drivers statement.

I disagree that you were in possession if you had no knowledge of the drug being there, but that is not the key. By being within reach of the drug, the police had probable cause to believe or, at least, a reasonable suspicion to think you were in possession. They then had the right to arrest or detain you to make a reasonable investigation to determine if you had the requisite intent.

After that investigation, it looks like they decided you didn't and let you go.
