My son was arrested for selling extacy to an undercover detective in Alabama. The stuff he sold was fake. He was charged by the D.A. with distribution. He sold it within
3 miles of a school zone and in Alabama, this is a mandatory 5 year sentence. Should he plead not guilty because the stuff he sold was fake and try to fight this in court. This was his first offense. Should he try to get the charge lowered to intent to distribute.

Sounds like you know your stuff/experienced this before.

Drug charges have become stricter over the years. As such, I don't think you want to play with the court system. Hiring a private attorney for your son will go a long way to help him; he may qualify for diversion/deferred judgment programs. http://www.attorneypages.com
