What is the name of your state (only U.S. law)? Ohio
I have first hand knowledge of an elderly bed-ridden woman who gave POA to her daughter, who is Mentally Incapable of carrying out these duties to there fullest extent. Also the POA has spent inordinate sums of money that belonged to the elderly woman.

The question is, How would we go about getting this Mentally Incapable person immediately removed from the premises? We understand that a Revocation of POA must be signed and filed, which we are in the process of doing, and getting a new POA signed and filed.

Also, can we bring theft charges against the Mentally Incapable Person?

Talk to a family law attorney about the best avenue to pursue on charges--it may be preferable to charge her with elderly financial abuse and/or abuse of power of attorney if she can not provide an accounting to prove she spent the monies on the lady's care.
