minor needs parent to make a charge against father

HI; In New York, A 16 year old boy charged his father with harrisment.
His mother ( the sole costodial parent) was needed to sign the document.
His parents are divorsed.
Tonight he went to the police department with his grandfather and had the charges dropped.
Is this legal? Does his mother( the costodial parent) need to sign here also?

The police must have accepted the grandfather's signature as a legal guardian.

If that is tru then it is illegal right? Only the mother has costody. thanks for replying- I love this web site.

There is a difference between having custody and being a legal guardian. If the grandfather has ever acted on behalf the the child, he would be considered a legal guardian. If his mother wishes to reinstate the charges, she can do so. She should also add to the charges that the grandfather is not a guardian of the child and cannot sign for him. It may also be possible in New York for a 16 year old to drop the charges himself. You should go to the police department and ask them personally how they handle situations such as this.
